1. Purpose

These Terms of Use (hereinafter the "Terms") define the conditions under which the service available at lesvoyagistes.com (hereinafter the "Service") is provided by DecOhm Solutions, a French limited liability company (SARL) registered with the Thionville Trade and Companies Register under number 105 788 293 (hereinafter the "Publisher", see Legal Notice above), as well as the rights and obligations of users (hereinafter the "User").

Use of the Service implies full and unreserved acceptance of these Terms.

2. Definitions

  • Service: the web platform available at lesvoyagistes.com that generates AI-assisted travel itineraries.
  • User: any natural person aged 15 or over accessing the Service, whether or not they have created an account.
  • Account: the personal space created by the User to access the Service's features.
  • Generated Content: the destination suggestions, itineraries, hotel, restaurant and activity recommendations produced by the Service.

3. Acceptance and modification of the Terms

Accessing the Service constitutes acceptance of these Terms without reservation. The Publisher reserves the right to modify the Terms at any time. New Terms take effect upon publication on the site. Users are invited to review them regularly. Continued use of the Service after modification constitutes acceptance of the new Terms.

4. Description of the Service

The Service is a travel-planning tool that uses artificial intelligence to generate personalized destination and itinerary suggestions based on preferences entered by the User (dates, type of trip, group composition).

The Service is currently offered free of charge. The Publisher reserves the right to introduce paid features in the future, subject to prior notice to the User.

The Service is not a travel agency within the meaning of articles L. 211-1 et seq. of the French Tourism Code. It does not handle bookings, sales, or intermediation of travel services. Any reservation made by the User with third parties (accommodation providers, carriers, service providers) is governed exclusively by the relationship between the User and those third parties.

5. Registration and user account

Use of the Service's main features requires the creation of an account. The User agrees to:

  • be at least 15 years old, or have parental consent in accordance with applicable law
  • provide accurate, complete and up-to-date information when registering
  • keep their login credentials confidential
  • inform the Publisher without delay of any unauthorized use of their account

The Publisher cannot be held liable for fraudulent use of an account resulting from the User's failure to meet these obligations.

6. AI-generated content

The User expressly acknowledges and accepts that:

  • the itineraries, recommendations and information produced by the Service are generated by artificial-intelligence systems, in particular the Anthropic Claude API
  • this content may contain inaccuracies, outdated information or errors, including regarding opening hours, prices, availability, location, or even the existence of the suggested establishments
  • the User undertakes to verify the accuracy of the information against official sources before any booking, travel or travel-related decision
  • the Publisher does not in any way guarantee the accuracy, completeness or currency of the generated content

This provision constitutes an essential condition of these Terms.

7. User obligations

The User undertakes to use the Service in accordance with its purpose and not to:

  • use the Service for fraudulent, illegal, or otherwise improper purposes
  • attempt to circumvent the Service's security measures or rate limits
  • extract or reuse, by automated means, all or part of the Service's content (scraping, crawling, data harvesting)
  • impersonate a third party
  • transmit malicious content, viruses or anything liable to harm the Service or its users
  • use the Service in a way that places a disproportionate load on its infrastructure

8. Intellectual property

All elements of the Service (interface, source code, logo, texts, graphics, database) are the exclusive property of the Publisher or its partners and are protected by French and international intellectual property law. Any unauthorized reproduction, representation, modification or exploitation constitutes infringement.

The User retains ownership of the preferences and data they enter. By using the Service, the User grants the Publisher a non-exclusive, royalty-free, worldwide licence, for the duration necessary to provide the Service, for the purpose of generating and displaying the requested itineraries.

9. Personal data

The processing of the User's personal data is governed by the Privacy Policy available at [URL — PRIVACY POLICY]. In accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act, the User has the right to access, rectification, erasure, portability, objection and restriction, which may be exercised by contacting [CONTACT EMAIL].

10. Third-party services

The Service relies on third-party providers for its operation, including:

  • Supabase (database hosting and authentication)
  • Anthropic (AI content generation)
  • Google (mapping services)
  • Upstash (request rate limiting)
  • Vercel (web hosting)

The Publisher is not responsible for the operation, availability or terms of use of these third-party services.

11. Availability of the Service

The Publisher endeavours to keep the Service available 24/7 but does not guarantee any particular level of availability. The Service may be interrupted for maintenance, updates, or any other technical reason, without notice. The Publisher cannot be held liable for the consequences of such interruptions.

12. Limitation of liability

To the fullest extent permitted by law, the Publisher cannot be held liable for:

  • direct or indirect damages resulting from use or inability to use the Service
  • financial loss, loss of profits or commercial damage resulting from decisions taken on the basis of the generated content
  • damages resulting from inaccuracy, incompleteness or obsolescence of the AI-generated content
  • the consequences of bookings, travel or travel-related decisions made by the User on the basis of the generated content
  • damages resulting from the User's own failure to meet their obligations

The Service is provided "as is", without warranty of any kind, express or implied. The above limitations do not apply to damages resulting from the Publisher's gross negligence or wilful misconduct, nor to cases where the law prohibits any limitation of liability.

13. Suspension and termination

The User may delete their account at any time by following the procedure indicated in their personal space or by contacting the Publisher at [CONTACT EMAIL]. Deletion of the account entails the deletion of associated personal data under the conditions set out in the Privacy Policy.

The Publisher reserves the right to suspend or delete any User's account in the event of a breach of these Terms, without notice or compensation.

14. Governing law and jurisdiction

These Terms are governed by French law. Any dispute relating to their interpretation or performance shall be submitted to the competent French courts, subject to the mandatory consumer-protection rules set out in the French Consumer Code.

In accordance with article L. 612-1 of the French Consumer Code, the User is informed of the possibility of resorting free of charge to a consumer mediator in the event of an unresolved dispute. The contact details of the competent mediator will be published here once designated by the Publisher.
